For residential properties within Houston city limits, a manual driveway gate installed on an existing fence generally does not require a building permit on its own. However, automatic gate operators involve electrical connections — and electrical work in the City of Houston does require a licensed electrician and may trigger an electrical permit, depending on the scope. If you are in an unincorporated area of Harris County, rules differ from within city limits, and Fort Bend County requires a permit for structures over six feet.

The soil beneath much of the Houston metro is Houston Black clay — sometimes called "gumbo" — an expansive clay that swells up to 30% in volume when saturated and contracts significantly during summer droughts. We set gate posts a minimum of 36 to 48 inches deep in concrete, with a flared bell-bottom footing that resists heave.
